Acceptance of Terms

Welcome to ExplainMyLetter. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and Halfmage - Gerrit Halfmann ("ExplainMyLetter", "we", "us", or "our") regarding your use of our document explanation service.

By creating an account, uploading documents, or purchasing credits, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Refund Policy

Refund window: If you purchased a credit pack and have not yet analyzed any letter using credits from that pack, you may request a refund within 14 days of purchase by emailing halfmage@gmail.com.

After credits have been used: By analyzing your first letter using a freshly purchased pack, you expressly request immediate performance and acknowledge that your right of withdrawal under EU consumer law is exhausted for that pack. We do not provide partial or pro-rated refunds for partially used packs.

Outside the 14-day window: All credit purchases are final and non-refundable. Credits never expire, so you can use them whenever you need.

Exceptions: regardless of the above, we will issue refunds or credits in cases of:

• Technical errors that prevent you from using purchased credits
• Duplicate charges or billing errors
• Extended service unavailability that materially affected your purchase

How to request a refund: email halfmage@gmail.com with your order ID (visible in your purchase history) and a brief description of the issue. We aim to respond within 48 hours.

Polar acts as our payment processor and Merchant of Record for EU sales. Refunds are processed through Polar back to your original payment method.

Account Terms

Account Creation

To use ExplainMyLetter, you must create an account. When creating an account:

• You must provide accurate and complete information
• You must be at least 18 years old or have parental consent
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• One person or entity may not maintain more than one account

Account Security

You are responsible for all activities that occur under your account. You must:

• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Not allow others to use your account
• Use strong, unique passwords

Account Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your use of the service disrupts or harms other users
• We are required to do so by law

You may delete your account at any time through your account settings. Upon deletion:

• Your personal data will be permanently removed from our systems
• Any remaining credits will be forfeited without refund
• Your document history and explanations will be deleted
• This action cannot be undone

Credit System

How Credits Work

ExplainMyLetter operates on a flat credit-based system:

• 1 credit = 1 letter analysis, regardless of file type or size
• New users must purchase a credit pack to use the service
• Credits are deducted only when an analysis completes successfully
• You can purchase additional credits at any time

Pricing

All prices are in EUR (€) and include applicable VAT for EU customers (handled by Polar as Merchant of Record). Current packs:

• Starter: 10 letters for €1.99
• Standard: 35 letters for €4.99
• Pro: 100 letters for €9.99

Prices may change for future purchases. Existing credits remain valid at the price you paid.

Credit Expiration

Credits never expire. Once purchased, credits remain in your account indefinitely until you use them.

Credit Purchases

Credits are purchased through Polar, our payment processor and Merchant of Record. When you purchase:

• Payment is processed immediately by Polar
• Credits are added to your account within seconds of payment confirmation
• Polar issues a VAT invoice you can download from your customer portal
• All purchases are subject to the refund policy above

Acceptable Use Policy

You agree to use ExplainMyLetter only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Uses

• Upload documents containing illegal content or that violate laws
• Upload documents you don't have the right to access or share
• Use the service to infringe on intellectual property rights of others
• Attempt to reverse engineer, decompile, or hack the service
• Use automated tools (bots, scrapers) to access the service
• Resell or redistribute our service without authorization
• Share your account credentials with others
• Upload malware, viruses, or malicious code
• Overload or disrupt our servers or networks
• Violate any applicable laws or regulations

Content Restrictions

While we don't actively monitor uploaded documents, you agree not to upload:

• Content that is illegal, threatening, or harassing
• Content that violates privacy rights of others
• Confidential information you're not authorized to share
• Content containing personal information of minors
• Sexually explicit or pornographic content
• Content promoting violence or terrorism

Consequences of Violations

Violation of this Acceptable Use Policy may result in:

• Immediate suspension or termination of your account
• Removal of violating content
• Forfeiture of remaining credits without refund
• Legal action if required by law
• Reporting to relevant authorities

Service Availability and Modifications

Service Availability

We strive to provide reliable service, but we cannot guarantee:

• 100% uptime or uninterrupted access
• Error-free operation at all times
• Specific response times for document analysis
• Availability in all geographic regions

We may temporarily suspend the service for:

• Scheduled maintenance and updates
• Emergency repairs or security updates
• Investigation of security incidents
• Technical issues beyond our control

Service Modifications

We reserve the right to:

• Modify, update, or discontinue features at any time
• Change pricing for future purchases (existing credits remain valid)
• Update our AI models or processing methods
• Impose usage limits or restrictions

We will provide reasonable notice of material changes when possible. Continued use of the service after changes constitutes acceptance of those changes.

Intellectual Property Rights

Our Intellectual Property

ExplainMyLetter, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. This includes:

• The ExplainMyLetter name, logo, and branding
• Website design, layout, and user interface
• Software, code, and algorithms
• Documentation, guides, and marketing materials

You may not copy, modify, distribute, sell, or lease any part of our service without explicit written permission.

Your Content

You retain all rights to the documents you upload. By using our service, you grant us a limited license to:

• Process and analyze your documents using AI
• Store your documents and explanations in your account
• Transmit your content to our AI service providers for analysis

This license terminates when you delete the document or your account. We do not claim ownership of your uploaded content.

Generated Explanations

The explanations generated by our AI are provided to you for your personal use. You may:

• Use explanations for personal or business purposes
• Share explanations as needed
• Copy and save explanations

However, you may not resell our explanations as a competing service or claim them as your own original work.

Disclaimers

AI Accuracy

Our service uses artificial intelligence to analyze documents. While we strive for accuracy:

• AI-generated explanations may contain errors or omissions
• AI may misinterpret context, nuance, or specialized terminology
• Explanations are general summaries, not comprehensive legal analysis
• Important details may be missed or mischaracterized

You are responsible for:

• Reading and understanding your original documents
• Verifying critical information (dates, amounts, deadlines)
• Seeking professional advice when needed
• Making your own informed decisions

Not Professional Advice

ExplainMyLetter does NOT provide:

• Legal advice: We are not lawyers and do not provide legal counsel
• Financial advice: We are not financial advisors
• Medical advice: We do not interpret medical documents professionally
• Tax advice: We are not tax professionals or accountants

For important matters, always consult with qualified professionals in the relevant field.

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties of uninterrupted or error-free operation
• Warranties that the service will meet your requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of profits, revenue, data, or use
• We are not liable for damages resulting from reliance on AI-generated explanations
• We are not liable for missed deadlines, financial losses, or legal consequences

Our total liability to you for all claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited or excluded under applicable law (including mandatory consumer protection law).

This limitation applies even if:

• We were advised of the possibility of damages
• The remedy fails its essential purpose
• The damages were foreseeable

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the extent permitted by law.

Governing Law & Disputes

Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles.

For consumers resident in the EU, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence (per EU Regulation 593/2008, Rome I).

Informal Resolution First

If you have a dispute with us, please email halfmage@gmail.com first. We aim to resolve issues informally within 14 days.

Online Dispute Resolution (EU)

EU consumers have access to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution before a consumer arbitration board, but will respond to good-faith complaints submitted there.

Courts

If informal resolution fails, the courts of Wrocław, Poland have exclusive jurisdiction over disputes arising from or related to these Terms, except that consumers may also bring proceedings in the courts of their country of habitual residence under EU Regulation 1215/2012.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service offerings.

When we make changes:

• We will update the "Last updated" date at the top of this page
• For material changes, we will notify you via email or prominent notice on our website
• Changes take effect immediately upon posting unless otherwise stated
• Your continued use of the service after changes constitutes acceptance

If you do not agree to the updated Terms, you must stop using the service and may delete your account.

We encourage you to review these Terms periodically to stay informed of any updates.
